Estimado Usuario,
Gracias por elegir OneKey. Estos Términos de Servicio de OneKey ("Acuerdo") se celebran entre usted ("Usuario") y OneKey. En este Acuerdo (a) "nosotros" nos referimos a la Compañía y "nuestro" se interpretará en consecuencia; y (b) "usted" se refiere al Usuario y "su" se interpretará en consecuencia. Cada uno de usted y la Compañía se denominarán en adelante una "Parte", y colectivamente, usted y la Compañía se denominarán en adelante las "Partes".
La Compañía le recuerda que debe leer atentamente el contenido completo de este Acuerdo y otros documentos mencionados en este Acuerdo antes de utilizar nuestra aplicación móvil "OneKey" disponible en varias plataformas móviles, incluyendo, entre otras, Google Play y Apple App Store ("OneKey" o "App"). En particular, debe leer atentamente la sección "Exclusión de Garantía y Limitación de Responsabilidad" y otras secciones que se muestran en negrita en este Acuerdo. Debe asegurarse de que comprende completamente todo el Acuerdo y evaluar los riesgos de usar OneKey por su cuenta.
I.Confirmation and Acceptance of this Agreement
2. Después de descargar OneKey y comenzar a crear, recuperar Identidad (definida a continuación) o importar billetera, se considera que ha leído y aceptado este Acuerdo, lo que hará que este Acuerdo entre en vigor y sea legalmente vinculante para usted y la Compañía inmediatamente. 3. Al acceder o utilizar OneKey, usted acepta:

a) to be bound by the latest version of this Agreement without variation or modification;
b) that in the jurisdiction to which you are subject, you are of legal age to use OneKeyand to create binding legal and financial obligations for any liability you may incur as a result of the use of OneKey; and
4. La Compañía puede, a su entera discreción, modificar o reemplazar este Acuerdo en cualquier momento. El Acuerdo modificado entrará en vigor automáticamente una vez publicado en OneKey y no se le notificará por separado. Si no está de acuerdo con las modificaciones, deberá dejar de usar OneKey inmediatamente. El uso de OneKey por su parte después de cualquier modificación de este Acuerdo constituye su aceptación de este Acuerdo modificado.
4.Company may, at its sole discretion, modify or replace this Agreement at any time. The modified Agreement will automatically take effect once it is posted on OneKey and you will not be notified separately. If you do not agree with the modifications, you shall cease to use OneKey immediately. Use of OneKey by you after any modification to this Agreement constitutes your acceptance of this Agreement as modified.
II.Definition
OneKey: significa la billetera de blockchain desarrollada por la Compañía basada en sistemas de blockchain y otras herramientas de soporte que se desarrollan para la conveniencia de los Usuarios al usar sistemas de blockchain.
Persona Excluida: a) una persona que no sea una persona física que posea capacidad legal y mental para celebrar este Acuerdo; o b) un Usuario que esté prohibido, restringido, no autorizado o no sea elegible de ninguna forma o manera, ya sea total o parcialmente, según este Acuerdo, leyes, requisitos regulatorios o reglas en la jurisdicción aplicable a dicho Usuario, para usar los Servicios (según se definen a continuación). Para evitar dudas, los Usuarios de China también están cubiertos por esta definición de 'Persona Excluida'.
a) una persona que no sea una persona física que posea capacidad legal y mental para celebrar este Acuerdo; o
Guía para Principiantes: significa la guía de operación proporcionada por la Compañía antes de que comience a usar OneKey (y durante su uso futuro de OneKey). Esta Guía para Principiantes le ayudará a comprender el conocimiento básico sobre blockchain.
Crear o importar billetera: significa su uso de OneKey para crear o importar una billetera después de su aceptación de este Acuerdo.
Contraseña de Billetera: significa la contraseña que usted establece al crear la billetera. La Contraseña de Billetera se utilizará para cifrar y proteger su Clave Privada. OneKey, como aplicación descentralizada, no almacenará su Contraseña de Billetera en nuestros servidores, ni su Contraseña de Billetera se almacenará en sus propios dispositivos móviles. Si pierde u olvida su Contraseña de Billetera, deberá restablecer la Contraseña de Billetera con su Clave Privada o Palabras Mnemotécnicas.
Alerta: significa los mensajes que se muestran en la interfaz de operación de OneKey y que brindan sugerencias a los Usuarios sobre operaciones posteriores.
Usuarios Específicos: significa Usuarios que deben cooperar con la Compañía y divulgar Información Personal para cumplir con las leyes, regulaciones y políticas de Singapur y otros países.
Usuarios Desarrolladores: significa Usuarios que utilizan los servicios proporcionados a los Desarrolladores, como el Código Fuente Abierto de OneKey y el modo Desarrollador, etc., de acuerdo con los avisos de la Compañía y la Licencia de Código Abierto correspondiente.
Clave Privada: consiste en 256 bits aleatorios. La Clave Privada es el núcleo para que el Usuario posea y utilice los Tokens.
Clave Pública: se deriva de la Clave Privada basándose en criptografía y se utiliza para generar direcciones de billetera. Una dirección de billetera es una dirección pública para recibir Tokens.
Palabras Mnemotécnicas: consiste en 12 (o 15/18/21/24) palabras generadas aleatoriamente, y se basa en BIP39, el estándar de la industria blockchain. Es un formato de palabras legible por humanos para respaldar su Clave Privada para la recuperación.
Keystore: significa Clave Privada o Palabras Mnemotécnicas en formato de archivo que está cifrado y protegido por la Contraseña de Billetera del Usuario. El Keystore se almacena solo en su dispositivo móvil y no se sincronizará con los servidores de la Compañía.
Tokens: significa los tokens que son compatibles con OneKey actualmente, incluyendo pero no limitado a BTC, ETH, DGD y demás.
Materiales: significa contenidos en las columnas de "Explorar", "Mercado", etc. en OneKey. Los Materiales son propiedades propietarias de terceros. El Usuario no deberá reproducir ni distribuir los materiales sin su permiso y autorización. Los Materiales mencionados anteriormente son únicamente para su referencia y no deben considerarse como guía o consejo sobre sus transacciones proporcionado por la Compañía.
Centro de Notificaciones: significa la bandeja de entrada donde los Usuarios pueden recibir mensajes o avisos de la Compañía.
Información Personal: significa información registrada en formato electrónico o de cualquier otro tipo que pueda identificar a una persona física cuando se utiliza sola o en combinación con otra información, incluyendo, entre otros, nombre, fecha de nacimiento, número de identificación, información de identificación biológica personal, dirección, número de teléfono, número de tarjeta bancaria, dirección de correo electrónico, dirección de billetera, información del dispositivo móvil, registro de operaciones, registro de transacciones, pero excluyendo Contraseña de Billetera, Clave Privada, Palabras Mnemotécnicas y Keystore.
Contrato Inteligente: significa el tipo de Contrato Inteligente que opera en la blockchain de Ethereum y que difunde, verifica y ejecuta contratos a través de métodos de información, incluyendo, entre otros, Contrato Inteligente Kyber y/o Contrato Inteligente 0x como se menciona en el presente. Los Contratos Inteligentes integrados en OneKey no proporcionan servicios entre blockchains.
ETH significa Ether, el token criptográfico asociado con la blockchain de Ethereum, que para evitar dudas no incluye "Ethereum Classic".
Código Fuente Abierto de OneKey ("OneKey OSC"): significa el código de software parcial de OneKey que la Compañía ha publicitado y lanzado como código abierto. Los Usuarios pueden usar (incluyendo desarrollo adicional) dicho código de software abierto de acuerdo con la Licencia de Código Abierto correspondiente y los avisos de la Compañía.
Licencia de Código Abierto: significa la licencia de código abierto desarrollada por terceros que los Usuarios Desarrolladores deben cumplir al usar OneKey OSC.
Servicio de Terceros: significa los productos y servicios proporcionados por terceros, como DApps desarrolladas por terceros, Contratos Inteligentes desarrollados por terceros, Licencia de Código Abierto desarrollada por terceros, billetera de hardware de criptomoneda desarrollada por terceros, página web desarrollada por terceros y exchange desarrollado por terceros, etc.
Third-Party Service:means the products and services provided by the third parties such as third-party-developed DApp, third-party-developed Smart Contract, third-party-developed Open Source License, third-party-developed crypto currency hardware wallet, third-party-developed webpage, and third-party-developed exchange etc.
Crear o Recuperar Identidad. Puede usar el botón "Crear Identidad", "Recuperar Identidad" en OneKey para crear o recuperar su Identidad y administrar billeteras multichain bajo una sola Identidad.
III.OneKey Services (collectively, the "Services")
Create or Recover Identity.You may use the "Create Identity", "Recover Identity" button on OneKey to create or recover your Identity and manage multi-blockchain wallets under one Identity.
Import wallet.You may use OneKey to create a new wallet or import wallets generated by other wallet application. You may only import wallets with Tokens which are supported by OneKey.
Transfer and receive Tokens.You may manage your digital Tokens by using the transfer and receipt functionalities of OneKey, i.e., you may revise the blockchain ledger by signing with your Private Key. Transfer of Tokens means the payer's transfer of the Token to the ENS domain or blockchain address of the payee. Such "transfer" of Tokens involves a validated record of such transaction on the distributed ledger of the relevant the blockchain system (rather than an actual delivery or transfer of Tokens on OneKey).
Observe the quotation.You may use OneKey to observe the quotation of the Tokens provided by third parties. The quotation of each Token is captured by OneKey from corresponding exchange and is displayed in the "Market" column on OneKey.
Manage Tokens.You may use OneKey to add, manage or delete the Tokens [from the OneKey interface] (except ETH and BTC) supported by OneKey.
Decentralized Exchange (DEX).Users may exchange digital Tokens with third parties on the third-party-developed Smart Contract 0x. OneKey acts as an interface tool for Users to interact with the third-party-developed Smart Contracts and displays relevant results of such exchange of digital Tokens.
Browse DApps.Users may use OneKey to visit and use the services provided by DApps (including DApps developed by Company and DApps developed by third parties).
Search DApps.Users may use search box on OneKey to search DApps already displayed on OneKey.
Integrate crypto currency hardware wallet.Users may match OneKey of appropriate version with certain crypto currency hardware wallet and use the crypto currency hardware wallet to confirm the transactions operated through OneKey.
Payment without Password.Users may use the function of Payment without Password of OneKey. The Payment without Password function stores Users' Wallet Password in the Keychain/Keystore of Users' mobile devices via secure encryption algorithm. Users' biological identification (Touch ID or Face ID) and authentication are called when conducting transactions, in order to quickly complete payment and signature.
Developer mode.For the convenience of Developer Users, they may access any websites and any third-party-developed DApps not integrated on OneKey by entering URL in search box under the Developer mode.
Transaction records.We will copy all or part of your transaction records from the blockchain system. However, Users shall refer to the blockchain system for the latest transaction records.
Los Usuarios que utilizan OneKey reconocen y aceptan que:
Con el fin de mantener la característica de descentralización de blockchain y proteger la seguridad de sus Tokens digitales, la Compañía ofrece un servicio descentralizado que es muy diferente de las instituciones bancarias y financieras. Los Usuarios reconocen y aceptan que la Compañía NO tendrá ninguna responsabilidad para:a) almacenar la Contraseña de Billetera de los Usuarios (la contraseña que los Usuarios establecen al crear o importar billeteras), Clave Privada, Palabras Mnemotécnicas o Keystore;b) recuperar la Contraseña de Billetera de los Usuarios, Clave Privada, Palabras Mnemotécnicas o Keystore;c) congelar la billetera;d) reportar la pérdida de la billetera;e) recuperar la billetera; o f) revertir transacciones.
Users who use OneKey acknowledges and accepts that:
In order to keep the decentralization feature of blockchain and to protect the security of your digital Tokens, Company offers decentralized service which is largely different from the banking and financial institutions. Users acknowledge and accept that the Company SHALL NOT have any responsibility to :
a) store Users' Wallet Password (the password Users set when creating or importing wallets), Private Key, Mnemonic Words or Keystore;
b) recover Users' Wallet Password, Private Key, Mnemonic Words or Keystore;
c) freeze the wallet;
d) report the loss of wallet;
e) recover the wallet; or
f) rollback transactions.
You shall bear sole responsibility to take care of your mobile devices, back up the OneKeyApp, and back up the Wallet Password, Mnemonic Words, Private Key and Keystore. In the event that: your mobile device is lost, your OneKey App or your wallet is deleted and not backed up, your wallet is stolen or you forget your Wallet Password, Private Key, Mnemonic Words or Keystore, the Company will not be able to recover the wallet or recover Wallet Password, Private Key, Mnemonic Words or Keystore. The Company may not be able to cancel transactions for the mishandling of Users (such as typing in wrong addresses for transactions, wrong amounts to be exchanged) and the Company shall not be responsible in any way in respect of the same.
When you use the function of Payment without Password of OneKey, please properly back up the Wallet Password. After multiple failed attempts to verify your Touch ID or Face ID, you will need to input your Wallet Password. If you forget Wallet Password, you need to import Mnemonic Words/Private Key and set a new Wallet Password. Company does not store your biological information such as your Touch ID or Face ID information, and the Company shall not be responsible in any way in respect of the same.
OneKeydoes not support all existing tokens. Do not use OneKey to handle any non-supported tokens.
The DApps integrated into OneKeyinclude those developed independently by Company and those developed by third parties. OneKey only provides blockchain search and browser functions for those third-party-developed DApps, and thus OneKey does not offer any guarantee for functions or service qualities of those third-party-developed DApps. Users shall, at their sole discretion, decide whether there would be any risks to accept the services provided by or to conduct transactions on the third-party-developed DApps.
The IEX and DEX functions of OneKeyenable Users to exchange digital Tokens via Smart Contracts (instead of OneKey) on the blockchain system in essence. As to services offered by the third-party-developed Smart Contracts, OneKey acts solely as a tool for Users to use the third-party-developed Smart Contracts, and thus does not provide any guarantee for functions or service qualities of those Smart Contracts. Before accepting services of or conducting transactions on such third-party-developed Smart Contracts, Users shall, at their sole discretion, decide the risks of services or transactions provided by such Smart Contracts.
The crypto currency hardware wallet integrated on OneKeyis provided by third party and OneKey does not provide any guarantee for functions or service qualities of the third-party-developed crypto currency hardware wallet, and OneKey does not guarantee that OneKey can be matched with any kind and version of crypto currency hardware wallet (please see the Company's notifications made from time to time). Before using third-party-developed crypto currency hardware wallet, Users shall, at their sole discretion, decide and assess the risks of such crypto currency hardware wallet. Users shall carefully read and agree with terms of use etc of such crypto currency hardware wallet updated from time to time.
If Users access any websites and any third-party-developed DApps not integrated on OneKeyby entering URL under the developer mode, Users shall understand the security risks of the websites and the third-party-developed DApps linked by such URL, and assume all risks and consequences independently.
In order to actively respond to the requirements of the ten Chinese ministries and commissions jointly issued the "Notice on Further Preventing and Disposing of the Risk of Virtual Currency Trading Hype" (hereinafter referred to as the "Notice"), the OneKey platform has terminated relevant part of the functional services for users in China, and the termination may involve transaction-related Financial applications that may not comply with regulatory documents such as the "Notice" or third-party platforms (see below for definitions) prescribed by laws and regulations only retain the basic service functions of the wallet. The third-party applications that have been terminated include but are not limited to: decentralized currency exchange, pledge mining, liquidity mining, lending, derivatives and other DeFi applications. OneKey is not the provider of these services and is not due to this. For this purpose, the user agrees to bear the risks and losses caused by the above circumstances, and agrees that OneKey shall not be liable for compensation or other responsibilities to the user.
IV.Your Rights and Obligations
1.Create or Import Wallet
c) La Compañía puede desarrollar diferentes versiones de OneKey para diferentes dispositivos terminales. Usted deberá descargar e instalar la versión aplicable. Si descarga e instala OneKey u otra aplicación con el mismo nombre que "OneKey" de un tercero no autorizado, la Compañía no puede garantizar el funcionamiento normal ni la seguridad de dicha aplicación. Cualquier pérdida causada por el uso de dicha aplicación será asumida exclusivamente por usted.
d) Una versión anterior de OneKey puede dejar de operar después de que se lance una nueva versión. La Compañía no puede garantizar la seguridad, el funcionamiento continuo o los servicios al cliente para la versión anterior. Los Usuarios deberán descargar y utilizar la última versión.
c) Company may develop different versions of OneKeyfor different terminal devices. You shall download and install applicable version. If you download and install OneKey or other application with the same name as "OneKey" from any unauthorized third party, Company cannot guarantee the normal operation or security of such application. Any loss caused by using such application shall be borne solely by you.
a) Usted será el único responsable de cuidar sus dispositivos móviles, Contraseña de Billetera, Clave Privada, Palabras Mnemotécnicas y Keystore. La Compañía no almacena ni posee esta información para los Usuarios. Usted será el único responsable de cualquier riesgo, responsabilidad, pérdida y gasto que resulte de fraudes, la pérdida de su dispositivo móvil o billetera de hardware de criptomonedas, la divulgación (ya sea activa o pasiva) u olvido de la Contraseña de Billetera, Clave Privada, Palabras Mnemotécnicas o Keystore, o que su billetera sea atacada.
2.Use of OneKey
c) Usted entiende que OneKey no asume ninguna responsabilidad de realizar la debida diligencia sobre el Servicio de Terceros. Usted deberá evaluar cuidadosamente y asumir todos los riesgos en conexión con el uso de OneKey.
d) Provisión de información y documentos. En la medida en que la Compañía determine, a su entera discreción, que es necesario obtener cierta información sobre el Usuario para cumplir con cualquier ley o regulación aplicable en conexión con el uso u operación de OneKey, el Usuario deberá proporcionar a la Compañía dicha información de inmediato a solicitud, y reconoce y acepta que la Compañía puede restringir, suspender o terminar su uso de OneKey hasta que dicha información solicitada haya sido proporcionada a satisfacción de la Compañía. El Usuario se compromete a notificar a la Compañía cualquier cambio en los documentos e información proporcionados por el Usuario a la Compañía de conformidad con este Acuerdo y, en ausencia de cualquier notificación por escrito que notifique cualquier cambio, la Compañía tiene derecho a asumir que los documentos e información proporcionados por el Usuario siguen siendo verdaderos, correctos, no engañosos y sin cambios.
e) Completar la verificación de identidad. Si la Compañía considera razonablemente que su operación o transacciones son anormales, o considera que su identificación es dudosa, o si la Compañía considera necesario verificar sus documentos de identificación u otros documentos necesarios, usted deberá cooperar con la Compañía y proporcionar sus documentos de identificación válidos u otros documentos necesarios y completar la verificación de identidad a tiempo.
f) Transferencia de Tokens Usted entiende que puede estar sujeto a límites diarios en la cantidad y veces de transferencias según su ubicación, requisitos regulatorios, propósitos de transferencia, control de riesgos por OneKey, o verificación de identidad. Usted entiende que las operaciones de blockchain son "irrevocables". Cuando utiliza OneKey para transferir Tokens, usted será el único responsable de las consecuencias de su mal manejo de la transferencia (incluyendo, entre otros, dirección incorrecta, problemas de los servidores de nodos seleccionados por usted). Usted entiende que las siguientes razones pueden resultar en un mensaje de "transferencia fallida" o "tiempo de minería excedido": saldo insuficiente en la billetera; gas insuficiente para la transacción; fallo de la blockchain en ejecutar el código de contratos inteligentes; la cantidad de transferencia excede los límites de transferencia impuestos por las autoridades, OneKey o leyes o regulaciones; fallo técnico de la red o equipo; transacciones abandonadas como resultado de congestión o fallo de la red blockchain; la dirección de la billetera suya o de su contraparte se identifica como direcciones especiales, como direcciones de alto riesgo. La Compañía se considerará que ha cumplido con sus obligaciones una vez que haya completado la transferencia y no será responsable de ninguna disputa relacionada con la misma.

Cuando utiliza OneKey para transferir Tokens, usted será el único responsable de las consecuencias de su mal manejo de la transferencia (incluyendo, entre otros, dirección incorrecta, problemas de los servidores de nodos seleccionados por usted).

j) Tarifas de servicio e impuestos. Cuando utiliza los servicios IEX y DEX, los Contratos Inteligentes desarrollados por terceros pueden cobrarle tarifas de manejo y/o tarifas de servicio, que estarán sujetas a las tarifas cobradas por esos Contratos Inteligentes, y la información relevante mostrada en OneKey es solo para su referencia; la Compañía no le cobra ninguna tarifa de servicio o manejo por el momento. La Compañía puede llegar a un acuerdo con usted o anunciar reglas sobre tarifas de servicio en el futuro; Usted necesita pagar "gas" o tarifas de red al transferir Tokens, cuyo monto será a su entera discreción y será cobrado por la red blockchain relevante; Usted entiende que su transferencia de Tokens puede fallar en ciertas circunstancias, incluyendo, pero no limitado a, gas o tarifas de red insuficientes pagadas por usted para la transferencia de Tokens durante el momento de su transferencia, o la red blockchain relevante que sea inestable, y en tal caso, aún se le puede cobrar gas por la red blockchain relevante, a pesar del intento de transferencia fallido; Usted será responsable de todos los impuestos aplicables y otros gastos ocurridos debido a sus transacciones en OneKey.
Cuando utiliza los servicios IEX y DEX, los Contratos Inteligentes desarrollados por terceros pueden cobrarle tarifas de manejo y/o tarifas de servicio, que estarán sujetas a las tarifas cobradas por esos Contratos Inteligentes, y la información relevante mostrada en OneKey es solo para su referencia;
la Compañía no le cobra ninguna tarifa de servicio o manejo por el momento. La Compañía puede llegar a un acuerdo con usted o anunciar reglas sobre tarifas de servicio en el futuro;
3.Developer Users' Development Based on OneKey OSC
si los Usuarios Desarrolladores encuentran alguna vulnerabilidad, defecto o solución de mejora de software al usar OneKeyOSC, los Usuarios Desarrolladores deberán contactar e informar a la Compañía de inmediato y cesar cualquier comportamiento de uso dañino (si corresponde);
OneKeyOSC puede contener Licencia de Código Abierto y código fuente desarrollados por terceros y la Compañía no ofrece ninguna garantía sobre las funciones, la ausencia de virus o vulnerabilidades, etc. de dicha Licencia de Código Abierto y código fuente desarrollados por terceros. Los Usuarios Desarrolladores, a su entera discreción, decidirán las consecuencias de usar OneKey OSC. Los Usuarios Desarrolladores deberán leer cuidadosamente y luego aceptar la Licencia de Código Abierto correspondiente (incluyendo, sin limitación, la Licencia de Código Abierto de Apache: http://www.apache.org/licenses/LICENSE-2.0.html) y los avisos de la Compañía actualizados de vez en cuando.
Si usted o su contraparte no cumplen con este Acuerdo o no siguen las instrucciones, consejos o reglas en el sitio web o en la página de la transacción o pago, la Compañía no garantiza la transferencia exitosa de los Tokens y la Compañía no será responsable de ninguna de las consecuencias de tal fallo. Si usted o su contraparte ya han recibido el pago en una billetera OneKey o una billetera desarrollada por terceros, usted entiende que las transacciones en blockchain son irreversibles e irrevocables. Usted y su contraparte asumirán las responsabilidades y consecuencias de sus transacciones.
V.Risks
You understand and acknowledge that the blockchain technology is a field of innovation where the laws and regulations are not fully established. You may be faced with material risks including instability of technology or failure for fiat-token exchange. You also understand that Tokens have much higher volatility comparing to other financial assets. You shall hold or dispose of the Tokens in a reasonable way and corresponding to your financial status and risk preferences. You also acknowledge that the market information is captured from exchanges by OneKeyand may not represent the latest or the best quotation of each Token.
If you or your counterparty fails to comply with this Agreement or fails to follow the instructions, tips or rules on the website or on the page of the transaction or payment, the Company does not guarantee successful transfer of the Tokens and the Company shall not be held liable for any of the consequences of such failure. If you or your counterparty has already received the payment in OneKeywallet or third-party-developed wallet, you understand that transactions on blockchain are irreversible and irrevocable. You and your counterparty shall assume the liabilities and consequences of your transactions.
You understand and acknowledge that IEX and DEX transactions are commenced, conducted and concluded on third-party-developed Smart Contracts. OneKeyis only an interface tool for Users to interact with the third-party-developed Smart Contracts and displays relevant results of such completed transactions.
When you use Third-Party Service through OneKey, Company strongly suggest you read the terms of use, privacy policy, and other relevant documents and information of such Third-Party Service carefully, get familiar with the counterparty and the product information and evaluate the risks before you make transactions on such third parties. You understand that such transactions and corresponding contractual relationship are between you and your counterparty, instead of the Company. The Company shall not be held liable for any risks, responsibilities, losses or expenses occurred due to such transactions.
When you transfer your tokens directly to another wallet address, it is your sole responsibility to make sure that your counterparty is a person with full capacity for civil acts and decide whether you shall transact with him/her.
You shall check the official blockchain system or other blockchain tools when you receive an Alert such as "transaction failed" or "mining overtime" in order to avoid repetitive transfer. If you fail to follow this instruction, you shall bear the losses and expenses occurred due to such repetitive transfer.
You understand that after you create or import wallet on OneKey, your Keystore, Private Key and Mnemonic Words are only stored on your mobile device and will not be stored in OneKeyor on the servers of Company. You may change another mobile device to use OneKey after you follow the instructions on OneKey to back up your wallet. If you lose your mobile device before you could write down or backup your Wallet Password, Private Key, Mnemonic Words or Keystore, you may lose your Tokens and Company will not be able to recover them. If your Wallet Password, Private Key, Mnemonic Words or Keystore is disclosed or the device which stores or holds your Wallet Password, Private Key, Mnemonic Words or Keystore is hacked or attacked, you may lose your Tokens and Company will not be able to recover them. Any and all losses arising in connection with the foregoing shall be borne solely by you.
We suggest you backup your Wallet Password, Private Key, Mnemonic Words and Keystore when you create or import wallet by writing them down on papers or backup them in password management apps. Please do not use electronic methods such as screenshots, e-mails, note-taking apps in cell phones, text messages, WeChat or QQ to backup any of the foregoing information.
When you choose and purchase crypto currency hardware wallet, we suggest that you should:
a) confirm whether your purchased crypto currency hardware wallet matches the OneKeyversion; and
b) choose and purchase a brand-new crypto currency hardware wallet from official channels.
When using the function of Payment without Password of OneKey, we remind you to use such function carefully and before using the same, we suggest that you should:
a) understand carefully the security level of biological identification function of your mobile device;
b) not turn on such function in a public phone; and
c) not turn on such function in case of relatively large amount of crypto currency.
Usted reconoce y acepta que la Compañía puede, a su entera discreción, ofrecer solo una parte de los Servicios por el momento, suspender ciertos Servicios o ofrecer nuevos Servicios en el futuro. Cuando cambiemos nuestros Servicios, su uso continuo de OneKey se considerará como su aceptación de este Acuerdo y las revisiones de este Acuerdo.
Para evitar (en la medida de lo posible) cualquier mal manejo de OneKey o cualquier riesgo para la seguridad de sus Tokens, usted no deberá usar OneKey si no posee el conocimiento básico de blockchain. Para los Usuarios que no poseen conocimiento básico de blockchain, la Compañía puede negarse a proporcionar todos o parte de los Servicios en OneKey a dichos Usuarios.
VI.Change, Suspension, Termination of Company Service

c) cambio adverso material de leyes o políticas aplicables; o
c) si usted proporciona Información Personal falsa en OneKey;
You are entitled to export your wallets within a reasonable amount of time if Company changes, suspends or terminates its Services.

VII.Your Representations and Warranties
The user declares that he has full capacity for civil rights and full capacity for civil conduct, can independently assume legal responsibility, and will never use platform services for any illegal purpose or in any illegal way. The user promises to abide by the relevant laws and regulations of the country where he is located and all international practices in the use of the Internet, and abide by all network protocols, rules and procedures related to platform services. If the relevant laws and regulations of the user's location or account registration place change, the user should abide by the latest laws and regulations, and actively avoid using the relevant products and services of the platform that are prohibited by relevant laws and regulations. The user guarantees to actively and fully pay the relevant taxes and fees incurred by the user's location and account registration place due to changes in the amount in the platform service account, and agrees that the platform has no relevant rights and obligations to supervise this. If the user violates this condition, OneKey may decide to refuse to provide services to the user at any time and at its sole discretion, and OneKey will not assume a series of joint and several liability for supervision and management due to the user's failure to comply with relevant laws and regulations in using relevant services. If this causes losses to OneKey or a third party, the user shall also bear full liability for compensation. If the user is a person with limited capacity for civil conduct, he can only use the platform under the supervision and participation of his parents or guardians, otherwise OneKey has the right to suspend or close the user's account within the scope permitted by law.You shall comply with all applicable laws and regulations of the country or area you reside in. You shall not use OneKeyfor any unlawful purposes or by any unlawful means.
You shall not be an Excluded Person who can't use OneKeyservices.
You shall not use OneKeyto commit any illegal or unlawful activities, including but not limited to:
a) activities endangering national security of the country or area you reside in, disclosing state secrets, overturning the government or undermining national unity;
b) any illegal conducts, such as money laundering, illegal fund raising etc.;
c) accessing Company services, collecting or processing the content provided by Company, intervening or attempting to intervene any Users, by the employment of any automated programs, software, network engines, web crawlers, web analytics tools, data mining tools or similar tools etc.;
d) providing gambling information or inducing others to engage in gambling;
e) invading into others' OneKeywallets to steal Tokens;
f) engaging in any inaccurate or false transactions with the counterparty;
g) committing any activities which harms or attempts to harm OneKeyservice system and data;
h) other activities which Company has reason to believe are inappropriate.
2. USTED RECONOCE Y ACEPTA QUE, HASTA EL MÁXIMO ALCANCE PERMITIDO POR LA LEY APLICABLE, OneKey SE PROPORCIONA SOBRE UNA BASE "TAL CUAL", "SEGÚN DISPONIBILIDAD" Y "CON TODOS LOS DEFECTOS". Usted reconoce que OneKey puede brindarle servicios y a su contraparte simultáneamente o puede tener afiliación u otra relación de interés con las partes anteriores, y usted acepta renunciar a cualquier conflicto de intereses real o potencial y no reclamará contra la Compañía sobre esta base ni le impondrá a la Compañía más responsabilidades o deberes de cuidado.

9.You are aware that OneKey is only a tool for Users to manage their Tokens and to display transaction information. Company does not provide legal, tax or investment advice. You shall seek advice from professional legal, tax, and investment advisors. In addition, Company shall not be liable for any investment loss, data loss etc. during your use of our service.
Sin Renuncia
Cualquier fallo de nuestra parte en hacer cumplir este Acuerdo o en hacer valer algún derecho(s), reclamo(s) o causa(s) de acción contra usted bajo este Acuerdo no se interpretará como una renuncia a nuestro derecho de hacer valer algún derecho(s), reclamo(s) o causa(s) de acción contra usted.
X.Miscellaneous
Este Acuerdo incluye estos Términos de Servicio de OneKey, la Política de Privacidad de OneKey y otras reglas (incluyendo los contenidos de la columna "Soporte") publicadas por la Compañía de vez en cuando.

No Waiver
Any failure by us to enforce this Agreement or to assert any right(s), claim(s) or causes of action against you under this Agreement shall not be construed as a waiver of our right to assert any right(s), claim(s) or causes of action against you.
Entire Agreement

Save for OneKey Terms of Service, OneKey Privacy Policy which are incorporated in this Agreement, this Agreement contains the entire agreement and the understanding between us and supersedes all prior agreements, understandings or arrangements (both oral and written) in relation to the use of OneKey and the services in connection thereto.

5.1 The use of Services shall be exclusive of all taxes that are applicable to, arising from, or in connection to your use of the Services in any jurisdiction ("Payable Tax").

XI.Others
You shall fully understand and conform to the laws, regulations and rules in your jurisdictions which are relevant to use of the Services.
During your use of the Services, if you come across any problems, you can contact us through the submission of your feedbacks on OneKey.
This Agreement is accessible for all Users on OneKey. We encourage you to read this Agreement each time you log onto OneKey.
As for any issues not covered in this Agreement, you shall comply with the announcements and relevant rules as updated by Company from time to time.
OneKey no longer offers some of its functional services to inland Chinese users.
